Terms of Use of the CleverConnect Site and Solutions

Use of the cleverconnect.com website (hereinafter the “Site”) and CleverConnect’s solutions (hereinafter the “Solutions”) constitutes the user’s acceptance of all the terms of use set forth below.

Article 1 - Purpose

These Terms of Use for the Site and CleverConnect Solutions (hereinafter “ToU”) set forth the terms under which users may access and use the Site and CleverConnect Solutions.

This document does not replace the contract entered into between CleverConnect and customers using the Solutions.

Article 2 - Services and Solutions

CleverConnect provides the following services on its Site:

  • A contact form to request a callback regarding CleverConnect’s Solutions or to request a demonstration of the Solutions;
  • A chatbot;
  • Subscription to the CleverConnect newsletter.

CleverConnect provides the following solutions:

  • Career Site: development, hosting, and maintenance of a customizable recruitment website;
  • Candidate Relationship Management (CRM) Platform: a SaaS solution for managing a pool of candidates and talent;
  • Employee Referral and Internal Mobility Platform (ERP): a SaaS solution for managing employee referrals and internal mobility;
  • Video Interviews: a SaaS solution enabling customers to conduct pre-recorded video interviews with candidates;
  • Qualify Agent: an AI-powered automated pre-screening interview.

Article 3 - User Obligations

When accessing and using the Site and CleverConnect Solutions, users agree to:

  • Comply with the provisions of these ToU and, where applicable, the terms of the contract between the user and CleverConnect, applicable laws, and the rights of third parties;
  • Provide only truthful, honest, and reliable information and documents;
  • Refrain from posting advertisements or resumes intended to promote products or services;
  • Refrain from disclosing personal information (text, photos, and videos) about third parties via the Site or the Solutions without their consent;
  • Refrain from uploading or distributing illegal content via the Site or the Solutions, including any content that is defamatory, abusive, obscene, offensive, discriminatory, hateful, violent, xenophobic, or infringes on the rights of third parties;
  • Refrain from uploading or publishing on the Site or the Solutions any content that would be contrary to the purpose of CleverConnect’s services;
  • Refrain from using the Solutions to send unsolicited bulk messages (such as advertisements).

In the event of a breach of one or more of these obligations, CleverConnect reserves the right to exclude the user from the Site or the Solutions.

Article 4 - Intellectual Property

The Site and all elements it contains, including, but not limited to, trademarks and product names, logos, icons, infographics, and photographs, are subject to international copyright and intellectual property laws. The content of the Site is the property of CleverConnect, 19D, or Talentry. Any use, reproduction, or adaptation, in any form or on any medium, of all or part of the Site and/or the elements it contains, without the express authorization of CleverConnect, 19D, or Talentry, is prohibited.

The logos of CleverConnect, 19D, and Talentry, as well as all other trademarks appearing on the Site, are registered trademarks of CleverConnect, 19D, or Talentry. All company names, logos, trademarks, and all other emblems and product names (whether or not designated as such) displayed or mentioned on the Site belong to their respective owners and, as such, are protected by applicable trademark laws and, where applicable, patent laws.

The intellectual property terms and conditions regarding CleverConnect's Solutions are set forth in the contract between the customer and CleverConnect.

Article 5 - Liability

Liability regarding the Site

CleverConnect is committed to taking all necessary measures to ensure the best possible access to the Site. It shall not be held liable in the event of force majeure or circumstances beyond its control, including service interruptions resulting from a failure of the telephone network or the user’s Internet service provider.

CleverConnect is not responsible for the use that users may make of the information and services available on the Site.

Despite the care taken by the CleverConnect team, the information contained on the Site is provided for informational purposes only and is subject to change without notice.

CleverConnect does not guarantee to users of the Site the accuracy, completeness, suitability, or functionality of the Site or the information it contains, nor does it guarantee that such information has been verified by CleverConnect.

Liability regarding the Solutions

The details of CleverConnect’s liability regarding the provision of its Solutions are set forth in the contract between the customer and CleverConnect.

Article 6 - CleverConnect’s Commitments

CleverConnect makes every effort to keep the Site free of malfunctions and errors, and to ensure a service availability of more than 95%. Please note that the service may be temporarily interrupted during maintenance operations or due to traffic spikes.

CleverConnect’s commitments regarding the provision of its Solutions are described in the contract between the customer and CleverConnect.

Article 7 - Duration

The ToU apply to users for the duration of their access to and use of the Site.

The duration of access to and use of CleverConnect Solutions is specified in the contract between the customer and CleverConnect.

Article 8 - Changes

CleverConnect reserves the right to modify the ToU at any time. In the event of any substantial changes, the updated terms will be communicated by any appropriate means and will take effect immediately.

Article 9 - Jurisdiction

Any dispute concerning the interpretation or performance of a contractual obligation relating to the Site shall fall within the exclusive jurisdiction of the French courts, which shall apply French law.

The designation of the courts with jurisdiction over access to and use of CleverConnect Solutions is specified in the contract between the customer and CleverConnect.
